Terms of Service

1. Acceptance of Terms

By downloading, installing, or using SwipeLeft ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

SwipeLeft is developed and operated by Winton Gee ("we," "our," or "us"). The App is a native iOS photo cleanup application that allows users to swipe left to mark photos and videos for deletion, and swipe right to keep them.

2. Eligibility

You must be at least 13 years of age to use SwipeLeft. By using the App, you represent and warrant that you meet this age requirement.

3. App Requirements

  • iOS 17.0 or later is required
  • iPhone device (the App is not optimized for iPad)
  • Full photo library access is required for the App to function

4. Free Tier and Subscription Plans

Free Tier

The free version of SwipeLeft includes a limit of 50 swipes per day. This limit resets daily at midnight in your local time zone.

SwipeLeft Pro

SwipeLeft Pro removes the daily swipe limit and provides unlimited access to all features. Pro is available through the following options:

  • Monthly Subscription: $4.99 per month (price may vary by region)
  • Lifetime Purchase: $14.99 one-time payment (price may vary by region)

Subscription Terms

  • Subscriptions are managed through the Apple App Store
  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Monthly subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • You can manage and cancel subscriptions in your App Store account settings
  • No refunds will be provided for partial subscription periods

5. Photo Deletion and User Responsibility

How Deletion Works

When you swipe left on a photo or video, it is moved to the in-app trash. You must confirm deletion in the Trash tab for photos to be removed. Deleted items are then moved to the iOS "Recently Deleted" album, where they remain recoverable for up to 30 days per Apple's standard policy.

Your Responsibility

You are solely responsible for reviewing and confirming which photos and videos you choose to delete. We strongly recommend:

  • Reviewing items in the in-app trash before confirming deletion
  • Maintaining regular backups of important photos and videos
  • Using iCloud Photo Library or other backup services

No Recovery Guarantee

While deleted photos remain in iOS's "Recently Deleted" album for 30 days, we cannot guarantee recovery of any deleted content. Once the 30-day period expires, photos are permanently deleted by iOS.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • The App will meet your specific requirements
  • Any data loss can be prevented or recovered
  • Defects will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WINTON GEE OR SWIPELEFT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, photos, or videos
  • Loss of profits or revenue
  • Loss of use of the App
  • Any damages arising from your use or inability to use the App

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

8. Apple App Store Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.

Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App.

9. Intellectual Property

The App, including its design, features, and content, is owned by Winton Gee and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to disclaimers, limitations of liability, and intellectual property provisions.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
